1. General Terms
Medley Ai offers refunds based on the terms outlined below. Refunds are evaluated on a case-by-case basis and will be granted at our discretion, in accordance with the progress of the project and services provided.
2. Refund Eligibility
Refund requests must meet the following criteria:
- Cancellation before Project Start: If a project has not yet commenced, clients may be entitled to a full refund of any deposits paid.
- Project Cancellation After Work Has Begun: If the project has already begun, refunds will be calculated based on the amount of work completed up until the point of cancellation. Refunds will be issued for the remaining balance, excluding work that has already been performed and any non-refundable fees.
- Milestone-Based Projects: For projects paid in milestones, refunds will only be applicable for uncompleted milestones. Once a milestone is delivered, that portion of the payment is non-refundable.
3. Refund Requests
To request a refund, the client must submit a written request to our support team at [support@medleyai.com]. Refund requests should include the following:
- Client name and project details.
- Specific reason for the refund request.
- Any relevant supporting documentation or communication.
4. Refund Processing Time
Refund requests will be processed within 15 business days from the receipt of the refund request. Depending on the method of payment, the actual refund may take additional time to reflect in the client’s account.
5. Non-Refundable Services
The following services are not eligible for a refund:
- Custom Development Work: Any work that has already been delivered, including design, code, and documentation.
- Third-Party Services & Licenses: Any third-party services or software purchased on behalf of the client (such as hosting, domain registration, or API services) are non-refundable.
- Late Payments: Failure to pay invoices within the specified terms does not entitle the client to a refund.
6. Changes or Revisions
We understand that project requirements may evolve. However, changes requested after project initiation may not justify a refund but will be assessed for additional work and adjustments to the original quote.
7. Dispute Resolution
In the event that a dispute arises regarding a refund or any aspect of the services provided, both parties agree to attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached, Binding Arbitration shall be the exclusive method of dispute resolution.
8. Binding Arbitration (New Mexico)
Any dispute, claim, or controversy arising out of or relating to this Refund Policy, the services provided by Medley Ai, or any other agreement between the parties shall be resolved through binding arbitration. The arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) and will take place in Albuquerque, New Mexico.
- The arbitration will be conducted by a neutral arbitrator agreed upon by both parties.
- Each party will bear its own costs and expenses of arbitration, except for the cost of the arbitrator, which will be shared equally unless the arbitrator rules otherwise.
- The decision of the arbitrator will be final and binding on both parties.
- Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
